Modal Windows Don't Play Nice With Pop Up Menus

Not sure if this is after all of the window updates or not, but now when I do [window setLevel:CPModalPanelWindowLevel]; [CPApp runModalForWindow:window]; on a window that contains popup menus, the window runs modal and stays on top, like it should. However when you activate a pop up menu (like the additional items toolbar element), the menu window appears behind the window.
